Terms of Service

Hiya is a creator discovery platform, monetization infrastructure, and collaboration marketplace.

Hiya is NOT:

• An employer, talent agency, or marketing agency
• A guarantor of collaborations, earnings, or campaign outcomes
• A contracting party in agreements between users

Hiya facilitates discovery and opportunity visibility between users. All collaborations, campaigns, agreements, deliverables, payments, and external communications are the responsibility of the users involved.

You must:

• Be at least 18 years old
• Provide accurate and truthful account information
• Have authority to act on behalf of a business if creating a business account

You may not:

• Impersonate other individuals, creators, or brands
• Create fraudulent or duplicate accounts
• Misrepresent follower counts, engagement metrics, or business identity
• Use the platform for unlawful activity

Hiya currently supports Creator/Influencer accounts and Business/Brand accounts. Features, pricing, trial access, and functionality may differ between account types and may change over time.

You retain full ownership of any content you upload to Hiya, including profile images, portfolio links, bio text, and campaign materials.

By uploading content, you grant Hiya a non-exclusive, worldwide, royalty-free license to:

• Host, store, and display your content on the platform
• Reproduce and distribute your content for platform functionality
• Use your content for creator discovery and profile display
• Feature your content in platform promotion or marketing materials
• Access your content internally for moderation and safety review

This license exists solely to operate and improve the platform. Hiya does not claim ownership of your content and will not sell it to third parties.

You are solely responsible for ensuring you have the rights to any content you upload. Hiya is not liable for copyright infringement resulting from user-uploaded content.

Users may not:

• Spam, harass, or repeatedly message creators or businesses in an unwanted manner
• Create fake accounts or impersonate brands, creators, or individuals
• Manipulate platform metrics, follower counts, or engagement data
• Engage in fraud, deceptive advertising, or misrepresentation
• Solicit or distribute sexually explicit, unlawful, or infringing content
• Post hate speech, discriminatory content, or make threats or intimidating statements
• Use fake reviews, fabricated testimonials, or artificial engagement
• Conduct scams, pyramid schemes, or deceptive commercial activity
• Maliciously abuse the reporting or moderation systems
• Engage in any conduct that harms other users or the integrity of the platform

Hiya is committed to maintaining a safe, professional marketplace. We reserve the right to take enforcement action at our discretion, including:

• Suspending or restricting account access
• Removing content that violates these Terms
• Temporarily or permanently terminating accounts
• Freezing or withholding payouts during fraud investigations or suspected abuse

Enforcement actions may be taken in response to:

• Harassment, hate speech, or abusive behavior toward other users
• Scams, fraud, or manipulation of platform systems
• Spam, fake engagement, or metric manipulation
• Impersonation or identity misrepresentation
• Illegal conduct or inappropriate solicitation
• Any behavior determined to be harmful to users or the platform

Hiya may investigate reports from other users but is not obligated to disclose the outcome of internal moderation decisions.

Hiya provides tools for creators and businesses to connect and collaborate. However, Hiya is not a party to any agreement, contract, or campaign arrangement between users.

Users are independently responsible for:

• Agreeing on campaign terms, deliverables, timelines, and compensation
• Requesting and managing content revisions
• Approving or rejecting submitted work based on agreed requirements
• Honoring commitments made to the other party

Hiya may review dispute reports and make moderation decisions to protect platform integrity, but is not obligated to arbitrate, mediate, or resolve disputes between users.

Creators remain responsible for delivering agreed-upon content. Businesses may reject submissions that materially fail to meet stated requirements, within the revision terms of a collaboration.

Hiya may facilitate payments through third-party processors, including Stripe and ACH transfer services.

By using payment features, you acknowledge:

• Hiya is not responsible for outages, delays, or errors caused by third-party payment processors
• Banking transfer delays, failed transactions, or chargebacks are outside Hiya's direct control
• Processing fees may apply and are subject to change
• Payout timing may vary based on processor requirements, banking schedules, or verification needs
• Hiya may temporarily hold payouts during active disputes, fraud investigations, or when suspicious activity is detected

Users are responsible for providing accurate banking and payment information. Hiya is not liable for misdirected payments resulting from inaccurate user-provided details.

Paid subscriptions renew automatically unless canceled before the renewal date. By subscribing, you authorize recurring billing.

Current pricing:

• Creator Pro: $7.99/month
• Business Pro: $39.99/month

Creator Explorer and Business Explorer are 12-day, no-credit-card trial experiences and do not automatically convert to paid subscriptions. Users must affirmatively upgrade to a paid Pro plan. Pricing is subject to change with reasonable notice.

Users may cancel subscriptions at any time. Cancellation prevents future renewal charges but does not retroactively refund prior billing periods.

Unless otherwise required by applicable law, subscriptions are non-refundable and partial billing periods are not prorated.

Hiya does not guarantee any specific outcome from using the platform. This includes but is not limited to:

• Creator earnings or income
• Campaign success, ROI, or conversion rates
• Audience growth or engagement improvements
• Sponsorship or collaboration opportunities
• Business performance or marketing results
• User activity levels or platform traffic

Results vary based on individual effort, profile quality, market conditions, and factors outside Hiya\'s control.

Hiya strives to maintain reliable platform availability but does not guarantee uninterrupted access. The platform may experience:

• Scheduled maintenance and updates
• Unexpected outages or technical interruptions
• Feature changes, additions, or removals over time

Hiya will make reasonable efforts to communicate planned downtime but is not liable for losses resulting from unavailability.

Hiya is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Hiya shall not be liable for:

• Failed campaigns, unmet deliverables, or campaign disputes
• Creator or business conduct or breach of informal agreements
• Product issues, shipping failures, or third-party service failures
• Payment disputes or processing errors from third-party services
• Indirect, incidental, special, or consequential damages
• Loss of revenue, earnings, data, or business opportunity

Users assume all risk associated with collaborations, external communications, and transactions.

Your use of Hiya is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using Hiya, you agree to the terms of our Privacy Policy.

Hiya reserves the right to update these Terms at any time. We will notify users of material changes via email or an in-app notice. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles, unless otherwise required by applicable law.
